Rental agreement
Version 2.1. In effect from September 24, 2026.
Version 2.1. Effective September 24, 2026. Replaces the September 21, 2026 agreement.
This agreement is between Total BS LLC, a New York limited liability company doing business as ROC Tote & Go ("we," "us," "our"), and you, the person who places the booking. By checking the box at checkout, you agree to this agreement electronically, and it has the same effect as a signed paper contract. You must be at least 18 and have authority to book for anyone else named on the order.
1. What you're renting
Reusable plastic moving totes (about 27 x 17 x 12 inches, with attached lids), dollies, and any add-on equipment listed on your booking (together, the "equipment"). Labels, zip ties, and packing supplies you buy are yours to keep. Everything else stays our property at all times. You may not sell, lend, sublet, alter, or remove our labels or tags from the equipment, and no one may place a lien on it.
2. Rental period
The standard rental is 14 days, from your delivery date to your scheduled pickup date. You may add weeks at your package's extra-week price, at booking or any time before pickup, subject to availability.
3. Delivery and pickup
- Delivery and pickup are free within our free delivery zone. Outside it, mileage is charged at the rate shown at booking, each way for both the delivery and pickup trips, and is quoted before you pay.
- We deliver and pick up in scheduled windows. You don't need to be present if you've given us a covered, accessible spot at ground level and told us where. Where a booking includes stairs or an elevator, say so in the booking notes so we can plan.
- Delivery ends at the ground-level entry of the delivery address, or the spot agreed in your booking notes. Where we agree to carry equipment beyond that point, we do so as a courtesy, and you are responsible for making sure the path is clear and safe.
- You'll provide safe access: no ice or snow blocking the path, animals secured, gates unlocked or codes provided. We may refuse or reschedule a delivery or pickup if a site is unsafe. A delivery we cannot complete because nobody is there, the spot is not accessible, or we were not told it was off is charged a trip fee (currently $25) to your saved card and rescheduled; a missed pickup is handled under section 9.
- At pickup, equipment must be empty, wiped out, lids closed, and stacked in one accessible place at the pickup address on your booking.
4. Where the equipment can go
Equipment stays at the delivery address and pickup address on your booking and in transit between them, within New York State. It doesn't go anywhere else. Tell us before pickup if an address changes; a change outside our service area may not be possible.
5. Condition at delivery
Equipment is delivered clean, sanitized, and in working order. Every tote and dolly carries a serial number; we count and scan each one at delivery, photograph the stack where we leave it, and do the same at pickup. That record is what we use to settle any question of what was delivered and what came back. Look the equipment over when it arrives. If anything is dirty, damaged, or missing, tell us within 24 hours of delivery by email with a photo. If we don't hear from you in that time, you accept the equipment in good condition and in the quantities on your booking.
6. Payment, deposit, and your card
- The rental price, add-ons, mileage, and applicable sales tax are paid in full by card at checkout. New York sales tax applies to rentals; it is not charged on the deposit.
- Deposit. A refundable deposit is charged with your payment as its own line, with no sales tax on it. The amount depends on the package ($75 to $300) plus $2 for each extra tote and $15 for each extra dolly, and is shown before you pay. We may lower or waive it for a returning customer.
- Saved card and replacement charges. By paying, you authorize us to store your payment method securely with our payment processor and to charge it for (a) extra weeks you request, (b) trip fees under section 3, and (c) loss, damage, cleaning, pest, late, or replacement charges under sections 7 through 9, after we've sent you an itemized notice with photos where applicable. We'll send the notice at least 48 hours before charging anything beyond the deposit. Where equipment is not returned, you authorize us to charge the replacement amounts in section 8 for every item still out, deposit first, on the timeline in section 9.
- Deposit refund. After pickup and inspection, we refund the deposit to the same card, less any charges under this agreement, within 5 business days of pickup. Your bank controls when it appears.
- Identity verification. Orders of 70 totes or more, office packages, and certain other bookings (for example a first booking whose card billing address differs from the delivery address, or one our payment processor flags as higher risk) require a short identity check after payment and before delivery: a government-issued photo ID and a live selfie, run by our payment processor. We don't see or keep the images. If the check can't be completed, or the name doesn't match the booking and we can't resolve it with you, we cancel the booking and refund it in full. We may waive the check for a returning customer.
- 3D Secure. Every card payment is submitted for authentication with your card issuer (3D Secure). Your bank may ask you to confirm the payment in its app or by a code. Payments you authenticate this way, and charges made under this agreement on the card you authenticated, are authorized by you.
- Discount codes, referral credits and gift cards are applied before you pay, follow the terms of use on our website, and can't be applied to the deposit. Credits and gift cards have no cash value.
- If a charge is disputed with your bank, you agree to contact us first so we can resolve it, and you agree that charges made under this agreement are authorized.
7. Care, prohibited uses, and safety
- No liquids, food residue, perishables, animals, hazardous or flammable materials, or anything illegal in the totes.
- Keep each tote at or under 50 pounds. Close lids before stacking and stack no more than four high.
- The equipment is for packing and moving household and office items only. Don't stand, sit, or climb on totes or dollies, use them as steps or seats, or let children play with them.
- Don't write on the equipment or apply your own tape or stickers. Use the labels we provide.
- Don't leave equipment outdoors, unattended in public, or in a vehicle overnight.
- Normal wear from ordinary moving is on us.
8. Loss, damage, cleaning, and pests
- If equipment is lost or stolen while it's in your care, you'll pay the replacement charge: currently $20 per tote and $65 per dolly. Equipment damaged beyond normal wear is charged at $20 per tote and $65 per dolly. These amounts reflect our actual replacement and handling costs, not a penalty.
- Totes returned with dirt, residue, or writing are charged a cleaning fee of $3 each. Equipment we can't clean is treated as damaged.
- A trip fee of $25 applies when we arrive for a scheduled delivery or pickup and can't complete it because nobody is there, the equipment isn't out, or we were not told the delivery or pickup was off.
- Pests. You confirm that, as far as you know, neither address on your booking has a bed bug, cockroach, or rodent infestation. If you learn of one during the rental, tell us before pickup. Equipment exposed to an infestation must be treated or destroyed; you'll pay the replacement charge for each affected item plus a treatment and disposal fee of $150 per order. We may decline pickup of infested equipment until it's bagged.
- You'll allow us to photograph the equipment at delivery and pickup, and the exterior of the delivery spot, to document condition.
9. Late and unreturned equipment
- Missed pickup. If equipment isn't ready at your scheduled pickup and you haven't added time, we extend your rental by one week at your package's extra-week price, charge it to your saved card, and ask you by email to pick a new date. Late return is charged only as whole extra weeks at that price; there is no separate daily late fee.
- Timeline. If we still can't arrange a pickup: about 7 days after the missed pickup we send a reminder; about 14 days after, we send an itemized notice of the replacement charges under section 8 for everything still out, with a 7-day window to return it; about 21 days after, we charge those amounts, applying your deposit first and the balance to your saved card. If the card can't be charged, we email you a payment link and the balance is owed. About 30 days after, if the balance is still unpaid, you can't book with us again until it is settled.
- Equipment that comes back in good condition within 30 days of being charged is refunded, less handling. Title to the equipment never passes to you, and we may recover it and our reasonable collection costs, including court costs and attorney's fees where the law allows.
10. Cancellations and changes
- Cancel 48 hours or more before your delivery date for a full refund, including the deposit.
- Cancel inside 48 hours and your deposit is refunded in full. The rental price, add-ons, mileage and tax are not refunded: the totes were held for you and turned away from others.
- Changing dates instead. You can move your delivery date at any time before delivery, subject to availability, by contacting us; the pickup date moves with it. Inside 48 hours of delivery the first change is free and each further change is charged the trip fee ($25).
- We may cancel or reschedule for severe weather, road conditions, or events outside our control. If we can't find a date that works for you, we'll refund you in full. That refund is your only remedy for a cancellation by us.
11. Our clean tote guarantee
Every tote is cleaned and sanitized before it reaches you. If it isn't, tell us on delivery day and we'll replace it or refund your delivery. This guarantee is our only warranty; the equipment is otherwise provided as is, and we disclaim any implied warranties to the extent New York law allows.
12. Responsibility and liability
- You're responsible for how the equipment is packed, lifted, stacked, moved, and used, and for its contents. We're not a moving company or a storage service, and we don't pack, load, or transport your belongings.
- We are not liable for loss of or damage to your belongings, or for injury to you or anyone helping you, arising from use of the equipment, except where caused by our negligence or willful misconduct.
- We are not liable for indirect or consequential losses such as a delayed move, lost time, or lost income.
- Our total liability to you under this agreement is limited to the amount you paid for the rental.
- You'll defend and indemnify us against claims by third parties (including anyone helping you move) that arise from your use of the equipment or your breach of this agreement, except to the extent caused by our negligence.
13. Tote tags and your packing list
- Each tote has a tag and a label that open a page for that tote. While the totes are on your booking, you (and anyone you unlock a phone or share a link with) can write what's inside, choose a room, and add a photo. What you write and photograph is yours; we store it so you can use it, staff can see your room list to help at delivery, and nobody sees your photos but you and the people you share them with.
- The feature is provided as is. If a tag doesn't read, the label and your account give you the same page. Nothing about the rental depends on using it.
- When the rental ends, your list is kept in your account as your record and removed from the totes. Photos you took are deleted 90 days after the rental ends.
- Don't remove, cover or rewrite the tags or labels.
14. Communications
By booking, you agree to receive emails about your rental (confirmations, delivery windows, reminders, receipts, fee notices), and phone calls on delivery and pickup days where we need to reach you. Our privacy policy at roctoteandgo.com/privacy explains how we handle your information.
15. Refusal of service
We may decline or cancel a booking, with a full refund, if we can't confirm your identity or payment, the addresses are outside our service area, or the site or request presents a safety concern.
16. Disputes
This agreement is governed by New York law. Any dispute will be brought in the courts located in Monroe County, New York, including small claims court where eligible, and you consent to that venue. If we have to take action to recover unpaid amounts or unreturned equipment, the prevailing party may recover reasonable costs and attorney's fees where the law allows.
17. The rest
- This is the whole agreement between us for your rental. Changes are valid only in writing (email counts). Our website describes the service but doesn't change these terms.
- If part of this agreement can't be enforced, the rest still applies.
- We may assign this agreement to a successor of the business; you may not assign it.
- Neither of us is responsible for delays caused by events beyond reasonable control, other than payment obligations.
- Notices to us go to support@roctoteandgo.com or (585) 204-2749. Notices to you go to the email and phone on your booking.
- We may update this agreement for future bookings; the version you accepted at checkout is the one that applies to your rental.
